203.1 General.
Sites, buildings, facilities, and elements are exempt from these requirements to the extent specified by 203.
EXCEPTION: In new construction, full compliance with the requirements of these standards is not required where an entity can demonstrate that it is structurally impracticable to meet the requirements. Full compliance will be considered structurally impracticable only in those rare circumstances when the unique characteristics of terrain prevent the incorporation of accessibility features. See additional information in 106.5.66. For purposes of ensuring compliance with requirements of Texas Government Code, Chapter 469, all determinations of structural impracticability are made by the Department in accordance with the variance procedures contained in Chapter 68, Texas Administrative Code.
