36 CFR Part 1191 ABA Accessibility Guidelines, Outdoor Developed Areas - Preamble
1. New Format for Guidelines
This final rule amends the Architectural Barriers Act Accessibility Guidelines, which were published in the Federal Register on July 23, 2004 (69 FR 44151) and are codified in Appendices C and D to 36 CFR part 1191. The guidelines were published as “camera ready” copy (i.e., images) in 2004 because they included figures after certain sections to illustrate technical requirements in the sections. Since it is not possible to amend the guidelines as published in 2004, we submitted the guidelines, as amended by the final rule, to the Federal Register as a Word document without figures, except for four mandatory symbols included at the end of Appendix D.1 The scoping requirements for the Americans with Disabilities Act Accessibility Guidelines in Appendix B are not changed. We did not include advisory sections that previously appeared in Appendices B, C, and D because they provide guidance only and do not contain mandatory requirements. We removed the List of Figures and Index in Appendix E because it did not contain regulatory material. We added notes to paragraphs (a) and (b) of section 1191.1 that reference the accessibility standards adopted by the Department of Justice and Department of Defense.
